As a result of the crash, our client sustained significant injuries requiring emergency transport to Freeman Health System. Her initial hospital treatment resulted in charges totaling $143,746.83, followed by additional treatment at Mercy Hospital with charges totaling $77,923.12.

Foster Wallace worked to resolve the case without the need for litigation. The at-fault driver was insured by Progressive Insurance, and our client carried underinsured motorist (UIM) coverage through USAA Casualty Insurance Company. Through negotiation, our firm secured two separate $100,000 settlements—one from the liability carrier and one from the UIM carrier—for a total recovery of $200,000.

In addition to securing the settlements, Foster Wallace achieved substantial lien reductions on our client’s behalf. The Freeman Health System lien was reduced by approximately 83.5%, from $143,746.83 to $23,699.07. A Mercy Hospital lien was likewise reduced by approximately 83.5%, from $37,161.95 to $6,126.77. Additional health-insurance liens were also resolved.

The case resolved pre-suit, allowing settlement funds to be distributed efficiently in December 2025. This outcome not only provided meaningful compensation for our client, but also significantly reduced the financial burden associated with medical treatment following a serious collision.

$665,000 Jury Verdict after $5,000 offer – Johnson County, Kansas Trial

This underinsured motorist (UIM) case arose from a rear-end collision that occurred on May 16, 2021, in Overland Park, Kansas. Our client was struck from behind while in the curbside pickup line at Jack Stack BBQ. At the time of the collision, our client was exiting his vehicle. Litigation and UIM Dispute

Foster Wallace filed suit in Johnson County District Court in May 2023 against the at-fault driver. Both the at-fault driver and State Farm believed that our client’s surgery and spine issues were pre-existing and had nothing to do with the wreck. The at-fault driver resolved her portion of the case prior to trial and was dismissed with prejudice. State Farm, however, continued to dispute the nature, cause, and value of our client’s injuries, forcing the case to trial. They only offered $5,000 before trial. 

Jury Trial and Verdict

The case proceeded to a jury trial in Johnson County District Court before the Honorable Rhonda Mason. After three days of testimony and evidence, the jury returned a verdict in favor of our client in the amount of $665,000. However, the Court was obligated to reduce the verdict to $400,000.00 which was the total available to our client under his UIM policy he purchased with State Farm.

Following the verdict, our law firm sought attorney fees pursuant to K.S.A. § 40-908, Kansas’ statute allowing recovery of attorney fees when an insurance company refuses without just cause to pay benefits owed under an insurance contract. The Court granted the motion and awarded more than $223,000 in attorney fees, which were entered as part of the final judgment.

Result

In total, the judgment entered in favor of Mr. Harvey exceeded $625,000.00, reflecting both the jury’s verdict and the Court’s attorney-fee award and costs. 

This case underscores the importance of purchasing underinsured motorist coverage and demonstrates that Kansas juries may hold insurance companies accountable when they wrongfully refuse to honor their contractual obligations to their own policyholders.

The Accident: Failure to Yield at Midland Drive and Maurer Road

In late November 2021, our client was traveling westbound on Midland Drive, approaching the intersection with Maurer Road. At the same time, another vehicle was stopped on Maurer Road, facing south. Foster Wallace recently settled a case for a young Bucyrus, Kansas woman who was outside of her car when an elderly man mistook the gas pedal for the brake pedal and hit her car while she was with her family having lunch at a Sonic Drive-In. Our client was outside of her minivan and walking to get her young daughter out of her car seat when the accident occurred. The elderly man hit the gas rather than the brake in his large SUV while in the Sonic parking lot, which then in turn then hit our client’s minivan, knocking our client down and landing on her shoulder, hip, and knee.

The Aftermath

Many months after the initial fall our client had knee surgery that we were able to prove was attributable to the accident. Two daughters recently secured two separate $100,000 settlements related to an accident that their father was injured as a passenger in and who later died from in Overland Park, Kansas. In April 2019, our clients’ father was a passenger in a car driven by his wife and attempting to turn on to 103rd Street in Overland Park, Kansas. The car that our clients’ father was in (and driven by his wife) was T-Boned by a car traveling on 103rd street. The car our clients’ father was in was eventually cited by the police for failure to yield. Foster Wallace was quickly engaged by the daughters to represent them and a spoliation letter was quickly sent to both their mother’s own insurance company and the other driver’s insurance company requesting that they not dispose of either of the cars so that Foster Wallace could examine them both.
Foster Wallace then engaged an expert to extract data from both the cars that showed the other driver was speeding prior to the accident and hit the brake less than a second before the accident. Because of this data, Foster Wallace turned down the other driver’s offers to settle this matter on the cheap and demanded and eventually obtained two policy limit offers for the daughters. Because this was a wrongful death claim, the settlement was recently approved by the Johnson County court in both cases.

Our client was bit by a dog in May 2021 in Sikeston, Missouri. This was not the first time this dog had bitten. Our client was staying at a friend’s house while her house was being remodeled. This aggressive dog, in an unprovoked attacked in the middle of the night, jumped onto our client’s bed and bit her in multiple places over her body including her face. She was transported to a hospital in St. Louis, Missouri where they performed plastic surgery on her lips. In this case, a young mother of three was involved in a horrific car wreck in Belton, Missouri that caused her to spend over two months in the hospital before unfortunately passing away. Her husband hired our firm to pursue potential claims arising from the wreck, including for wrongful death. After engaging Foster Wallace, LLC, we quickly sent out a spoliation letter and was able to preserve certain evidence including video of the wreck from a neighboring business and downloads from the two vehicles that showed the speeds of the two cars. In this case, Foster Wallace received a call from the client a few days after a summer 2020 car wreck that took place on I-435 in Kansas City, Missouri. The wreck led our client to go to the emergency room a day after the wreck with back pain. What complicated matters was that our client, a passenger in the vehicle that was struck, was not even listed on the police report and the insurance company denied complete liability. Inmate Assault Victim Settles for $1,414,418 After Jail Personnel Refused Repeated Requests for Medical Attention

Our client, a 35-year-old man named James, was arrested while he was extremely intoxicated early in the morning on February 3, 2017 and was subsequently booked into County Jail in Missouri. Later that night, James suffered a vicious and unprovoked attack at the hands of a fellow inmate that left him with life-threatening injuries. Despite repeated requests for medical attention, jail personnel did nothing to get him the help he so desperately needed.James ultimately sought assistance from three highly-regarded area attorneys to bring a lawsuit against jail staff and the county for the attack and lack of medical supervision that followed the attack. Those three lawyers each declined to represent him in a lawsuit. That is when Foster Wallace, LLC stepped in and helped him obtain the compensation—and the justice—he deserved.

Assault by a Fellow Inmate Left James Severely Injured

On the night of February 3, 2017—his first night in County Jail—James was involved in an unprovoked attack by a fellow inmate. The inmate entered James’s cell and locked his neck into a chokehold. James collapsed during the assault, unable to feel his hands.

Jail Personnel Refused Repeated Requests for Medical Attention

James was still on the ground when jail personnel came by on their nightly rounds. James told them he was injured and needed to see a doctor or a member of the medical staff as soon as possible. Instead, he was simply moved to a different pod in the jail. James was forced to spend the next four days in agony, as his repeated pleas for medical attention went unanswered.

County Jail personnel refused to get James help. It wasn’t until February 7—after he’d complained about his injuries to the judge during his arraignment—that they brought a portable x-ray machine into the jail to examine his neck. With a neck fracture visible on the x-ray, James was taken to two different hospitals for further evaluation. The medical professionals at both facilities diagnosed him with a life-threatening “hangman’s fracture,” which required him to undergo an emergency spinal fusion surgery to prevent his death. This surgery, while life-saving, left James unable to move his neck.

We Agreed to Assist James in His Fight for Justice When Other Attorneys Wouldn’t

James was determined to hold the negligent jail personnel accountable, but finding an attorney to represent him proved difficult. His case was declined by attorneys at three well-known firms before he decided to take legal action on his own and file a lawsuit in the United States District Court for the Western District of Missouri.

Foster Wallace was contacted by the federal judge assigned to James’s case and asked if we would talk to him and consider becoming his legal counsel. After meeting with James, we agreed to represent him.

How We Helped James Resolve His Lawsuit

James initially filed his lawsuit naming John Does as defendants, as he did not know the names of the staff members at County Jail who refused to give him medical attention. We quickly got to work gathering documents from the County prosecutor regarding the underlying attack, amending the complaint, and sent discovery requests to County in an attempt to identify the appropriate defendants. Not only were we able to find out who the culpable parties were and interview potential witnesses with what we had discovered, but through discovery we were also able to determine that jail staff had manipulated James’s records to cover up what happened to him.

When we had enough information, we sent a demand letter asking for the insurance policy limits of $1,414,418 (this was the sovereign immunity cap in 2017 plus $1,000,000.00), as neither jail personnel or the county itself had significant assets to collect from. The defendants accepted our settlement offer and James elected to structure a portion of his settlement, allowing him to receive monthly payments until 2049.

Foster Wallace is pleased to announce that clients recently settled their respective cases for the collective sum of $1,500,000.00 after they were struck in a crosswalk while walking on Johnson Drive in Mission, Kansas. The case was settled just before the trial, bringing closure to a case that involved severe negligence on the part of the driver and life-altering injuries for our two wonderful clients.The incident occurred when the defendant driver entered an intersection, striking two women and three dogs. The driver could not recall the traffic light’s color at the time of the accident, and the only witness supporting the defendant’s claim of having a green light later admitted under oath that she was unsure of the light’s color. The evidence pointed to one conclusion in our opinion: the defendant hit two pedestrians who had the right of way in the crosswalk.The injuries sustained by our clients were severe and permanent. The defendant’s medical expert even acknowledged the permanence of these injuries and conceded that future medical interventions, including pain management and potential surgeries, were reasonable. Despite the defense’s efforts, the evidence, including x-rays and testimony from multiple physicians, indicated that future medical care was not just possible but inevitable.
As noted above, the case was settled for $1,500,000 just before trial and after the Pre- Trial Conference that occurred in Johnson County District Court. This outcome ensures fair compensation for our clients while highlighting the importance of accountability and the value of pedestrian safety. Foster Wallace and co-counsel reached a $7.25 million wrongful death settlement in Kansas on behalf of our client who lost his wife and their unborn child. The defendants, a trucking company and its driver, were never listed on the Kansas Highway Patrol report, and the investigating patrolmen were unable to determine the sequence of events leading to the crash. Following an extensive investigation, it was our position that the defendant driver recklessly merged into the decedent’s lane, forcing her into oncoming traffic headed in the other direction where she was struck and killed.
